Minimum Qualifications

On or before January 27, 2024, you must be a qualified employee of New York State and have had three months of permanent competitive or 55-b/55-c service as follows:

For No. 38-569010:

Either A. as a Tax Compliance Agent 1, Tax Compliance Agent 1 (Spanish Language), Tax Compliance Agent Trainee, or Tax Compliance Agent Trainee (Spanish Language);

Or B. as a Tax Compliance Representative 2 or Tax Compliance Representative 2 (Spanish Language).

For No. 38-570010:

Either A. as a Tax Compliance Agent 2;

Or B. as a Tax Compliance Representative 3.

Only the title or titles listed are qualifying. Titles that can transfer into those listed in the Minimum Qualifications do NOT qualify for examination purposes.

If you were permanently appointed to a qualifying title on or before October 27, 2023, and have served continuously in this title since that date, you are eligible to file for this examination.

Qualifying Experience For Appointment From The Eligible List:

For No. 38-569010: After one year of service as a Tax Compliance Agent 1 or Tax Compliance Agent 1 (Spanish Language), successful candidates will be qualified for appointment from the eligible list.

For No. 38-570010: After one year of service as a Tax Compliance Agent 2 or Tax Compliance Representative 3, successful candidates will be qualified for appointment from the eligible list.

Eligibles who meet the ?B? qualifications, and who are subsequently appointed to an ?A? title, may request to have their name added to the ?A? list, once they have completed the one year of service in the ?A? title. The request should be submitted in writing to the NYS Department of Civil Service, Albany, New York 12239; Attention: S-3/SER.

Order of Certification: The order of certification of this eligible list will be:

  1. Promotion Unit "A" eligibles
  2. Promotion Unit "All" eligibles
  3. Department "A" eligibles
  4. Department "All" eligibles
  5. Interdepartmental "A" eligibles

The Positions: Tax Compliance Agent 2 positions exist in both the Department of Taxation and Finance and the Department of Labor and are located statewide. Tax Compliance Agent 3 positions exist in both the Department of Taxation and Finance and the Department of Labor. The Department of Labor's positions are located in Albany and New York only. The Department of Taxation and Finance's positions are located statewide.

Duties

As a Tax Compliance Agent 2, at the Department of Taxation and Finance, you would be responsible for the supervision, development and evaluation of Tax Compliance Agents 1 and Trainees in the collection of delinquent taxes or other financial obligations, or work independently to achieve compliance in high value and/or more complex collection cases. Incumbents maintain and apply current knowledge of New York State Tax Laws, Department collection tools, and procedures and regulations. You would conduct in-depth field investigations and ensure that the field activities of assigned staff are performed in accordance with Department rules and policies. You would work with financial analysts to perform detailed analysis of taxpayers? financial condition. You would make decisions concerning the resolution of cases and assist staff by providing procedural and policy guidance. You would act as an advocate or witness on behalf of the Department in conferences, hearings, or civil actions. You would have regular contact with legal representatives. You may work on special projects as assigned. In connection with these assignments, off-shift work may be required. Travel in order to conduct field investigations may be required. Occasional overnight and weekend travel may be required.

As a Tax Compliance Agent 3, at the Department of Taxation and Finance, you would be required to ensure that staff activities are in accordance with all New York State Tax Laws, statutes, regulations, policies, and procedures. You would be responsible for leading and developing subordinate personnel involved in the collection of delinquent taxes or other financial obligations. You would be responsible for monitoring organizational work-flow, identifying actual or potential problems, recommending and/or implementing solutions. You would meet with staff on a regular basis and ensure that information is disseminated accurately. You would be required to prepare written reports and present oral reports. As necessary, you would meet with taxpayers and legal representatives. You would be required to manage a program or organization in the absence of a Tax Compliance Manager. As such, you would independently lead and review the organizational unit?s activities to ensure the quality of work and the successful completion of the program or organization?s mission. As directed, you would work on special projects and executive correspondence. When required, you would act as an advocate or witness on behalf of the Department in conferences, hearings, or civil actions. In connection with these assignments, off-shift work may be required. Travel in order to conduct field investigations may be required. Occasional overnight and weekend travel may be required.

As a Tax Compliance Agent 2, at the Department of Labor, you would collect delinquent contributions, penalties and interest; obtain past due contribution returns (NYS 45s); and work independently to achieve compliance on more complex and high value collection cases. You would supervise Tax Compliance Agents 1, and other staff in the office. You would maintain and apply current knowledge of New York State Unemployment Insurance and Tax Laws, Department collection tools, procedures and regulations. You would conduct in-depth field or office investigations and ensure that the activities of assigned staff are performed in accordance with Department rules and policies. You would make decisions concerning case resolution and assist staff by providing procedural and policy guidance. You would act as an advocate or witness on behalf of the Department in conferences, hearings, or civil actions. If assigned to Central Office operations, you would review the work of statewide collection staff and handle special cases involving data from confidential sources, bankruptcy and estate matters, and special collection matters. You would also have regular contact with legal representatives. In connection with these assignments, off-shift work may be required.

Note: Most Tax Compliance Agent positions will require candidates to possess a valid NYS driver?s license at the time of appointment and continually thereafter; other positions will require candidates to demonstrate their continued capacity to meet the transportation needs involved in carrying out their work responsibilities.

Subject of Examination

To be considered for appointment to this title, you must pass the multiple-choice test. The multiple-choice test evaluates your knowledge, skills, and/or abilities in the following areas: For Examination Numbers

1. Evaluating conclusions in light of known facts - These questions will consist of a set of facts and a conclusion. You must decide if the conclusion is proved by the facts, disproved by the facts or if the facts are not sufficient to prove or disprove the conclusion. The questions will not be specific to a particular field. XX
2. Understanding and interpreting written material - These questions test for the ability to understand and interpret written material. You will be presented with brief reading passages and will be asked questions about the passages. You should base your answers to the questions only on what is presented in the passages and not on what you may happen to know about the topic. XX
3. Preparing written material - These questions test for the ability to present information clearly and accurately, and to organize paragraphs logically and comprehensibly. For some questions, you will be given information in two or three sentences followed by four restatements of the information. You must then choose the best version. For other questions, you will be given paragraphs with their sentences out of order. You must then choose, from four suggestions, the best order for the sentences. XX
4. Investigative techniques -These questions test for knowledge of the fundamental concepts in the area of field investigation. The questions will cover such areas as: obtaining the cooperation of individuals involved in an investigation, preparing for the investigation and/or interview, investigative principles, interviewing principles and practices, behavior and attitudes of the investigator and others, gathering of data and evidence, and presenting the results of an investigation. Many of the questions are situational in nature and attempt to measure the candidate's ability to apply basic investigative techniques. The questions are generic rather than dealing with investigations in a particular field. XX
5. Supervision - These questions test for knowledge of the principles and practices employed in planning, organizing, and controlling the activities of a work unit toward predetermined objectives. The concepts covered, usually in a situational question format, include such topics as assigning and reviewing work; evaluating performance; maintaining work standards; motivating and developing subordinates; implementing procedural change; increasing efficiency; and dealing with problems of absenteeism, morale, and discipline. 6. Administrative supervision - These questions test for knowledge of the principles and practices involved in directing the activities of a large subordinate staff, including subordinate supervisors. Questions relate to the personal interactions between an upper level supervisor and their subordinate supervisors in the accomplishment of objectives. These questions cover such areas as assigning work to and coordinating the activities of several units, establishing and guiding staff development programs, evaluating the performance of subordinate supervisors, and maintaining relationships with other organizational sections. If you pass, your seniority credit(s), if any, will be included in the computation of your final score. Your final score on the eligible list will be determined after adding any wartime Veterans' credits.

Credit For Seniority: Seniority is credited at the rate of one credit for each five-year period (or fraction thereof), excluding the first year of service.

Admission To The Test: If approved for a multiple-choice test, you will receive an admission notice which will indicate your assigned test date and the way your test will be administered. Your test may be administered with paper and pencil or online at a state test site using a state-provided Chromebook. You cannot request to change your scheduled day or request a specific type of test administration.

Applicants are required to have a Personal NY.gov account and keep their email address up to date. The Department of Civil Service and other state agencies will communicate with you through email correspondence. This may include the notification of your application status, your test arrangements, examination results, and canvassing you for interest in appointment. Taking State and Local Examinations Scheduled for the Same Day

If you have applied to take a multiple-choice test announced by either one or several local jurisdictions (county, town, city) scheduled to be held on the same test date as this multiple-choice test, you must notify each of the local jurisdictions no later than two weeks before the test date to make arrangements for taking all tests at one test site. All tests will be held at the state examination center. Eligibility for Examination

To be considered a qualified employee eligible to compete in this examination, you must be employed in, or on leave from, the specified department or agency on a permanent or contingent permanent basis in the competitive class, or in the non-competitive class or labor class if specifically noted on this announcement (or be on an appropriate preferred list), and have the specified time in the specified title or salary grade. You may not compete in a test for a title if you are permanently employed in that title (unless you are still on probation) or in a higher direct line of promotion.

Cell Phones or Electronic/Communication Devices at the Test Site

The use of cell phones, beepers, headphones, or any electronic or other communication devices at your personal testing site or in the test room, hallways, restrooms, building, grounds, or other areas, except as expressly authorized by the Department of Civil Service, could result in your disqualification.
