Minimum Qualifications

On or before June 4, 2016, you must be a qualified employee of the New York State Department of Taxation and Finance or the Division of Tax Appeals and have had two months permanent competitive or 55-b/55-c service as follows:

For Number 37-589010: as a Tax Compliance Agent Trainee, Tax Compliance Agent Trainee (Spanish Language), Tax Compliance Agent 1, Tax Compliance Agent 1 (Spanish Language), Tax Compliance Representative 2, or a Tax Compliance Representative 2 (Spanish Language).

For Number 37-590010: as a Tax Compliance Agent 2 or Tax Compliance Representative 3.

If you were permanently appointed to a qualifying title on or before April 4, 2016, and have served continuously in this title since that date, you are eligible to file for this examination.

NOTE: Only the titles listed are qualifying for this examination. Titles that can transfer into those listed in the Minimum Qualifications do not qualify for examination purposes.

Qualifying Experience for Appointment from the Eligible List

After one year of the service described in the Minimum Qualifications*, successful candidates will be qualified for appointment from the eligible list.

* Trainees must complete one year of qualifying service in the journey level title to be qualified for appointment from the eligible list.

Subject of Examination

There will be a written test which you must pass in order to be considered for appointment. The written test is designed to test for knowledge, skills, and/or abilities in such areas as: For Examination Numbers

1. Preparing written material - These questions test for the ability to present information clearly and accurately, and to organize paragraphs logically and comprehensibly. For some questions, you will be given information in two or three sentences followed by four restatements of the information. You must then choose the best version. For other questions, you will be given paragraphs with their sentences out of order. You must then choose, from four suggestions, the best order for the sentences. X X
2. Understanding and interpreting written material - These questions test how well you comprehend written material. You will be provided with brief reading selections and will be asked questions about the selections. All the information required to answer the questions will be presented in the selections; you will not be required to have any special knowledge relating to the subject areas of the selections. X X
3. Evaluating conclusions in light of known facts - These questions will consist of a set of facts and a conclusion. You must decide if the conclusion is proved by the facts, disproved by the facts or if the facts are not sufficient to prove or disprove the conclusion. The questions will not be specific to a particular field. X X
4. Investigative techniques - These questions test for knowledge of the fundamental concepts in the area of field investigation. The questions cover such areas as obtaining the cooperation of individuals involved in an investigation, preparing for the investigation and/or interview, investigative principles, interviewing principles and practices, behavior and attitudes of the investigator and others, gathering of data and evidence, and presenting the results of an investigation. Many of the questions are situational in nature and attempt to measure the candidate's ability to apply basic investigative techniques. X X
5. Supervision - These questions test for knowledge of the principles and practices employed in planning, organizing, and controlling the activities of a work unit toward predetermined objectives. The concepts covered, usually in a situational question format, include such topics as assigning and reviewing work; evaluating performance; maintaining work standards; motivating and developing subordinates; implementing procedural change; increasing efficiency; and dealing with problems of absenteeism, morale, and discipline. 6. Administrative supervision - These questions test for knowledge of the principles and practices involved in directing the activities of a large subordinate staff, including subordinate supervisors. Questions relate to the personal interactions between an upper level supervisor and his/her subordinate supervisors in the accomplishment of objectives. These questions cover such areas as assigning work to and coordinating the activities of several units, establishing and guiding staff development programs, evaluating the performance of subordinate supervisors, and maintaining relationships with other organizational sections.   X

If you pass, your seniority credit(s), if any, will be included in the computation of your final score. Rank on the eligible list will be determined after adding any wartime veterans' credits to your final passing score.

Seniority is credited at the rate of one credit for each five-year period (or fraction thereof), excluding the first year of service.

Duties

As a Tax Compliance Agent 2, you would be responsible for the supervision of Tax Compliance Agents in the collection of delinquent taxes or other financial obligations, or work independently to achieve compliance in high value and/or more complex collection cases. Incumbents maintain and apply current knowledge of New York State Tax Laws, Department collection tools, and procedures and regulations. You would conduct in-depth field investigations and ensure that the field activities of assigned staff are performed in accordance with Department rules and policies. You would work with financial analysts to perform detailed analysis of taxpayers??? financial condition. You would make decisions concerning the resolution of cases and assist staff by providing procedural and policy guidance. You would act as an advocate or witness on behalf of the Department in conferences, hearings, or civil actions. You would have regular contact with legal representatives. You may work on special projects as assigned. In connection with these assignments, off-shift work may be required.

As a Tax Compliance Agent 3, you would be required to ensure that staff activities are in accordance with all New York State Tax Laws, statutes, regulations, policies, and procedures. You would be responsible for leading and developing subordinate personnel involved in the collection of delinquent taxes or other financial obligations. You would be responsible for monitoring organizational work-flow, identifying actual or potential problems, recommending and/or implementing solutions. You would meet with staff on a regular basis and ensure that information is disseminated accurately. You would be required to prepare written reports and present oral reports. As necessary, you would meet with taxpayers and legal representatives. You would be required to manage a program or organization in the absence of a Tax Compliance Manager. As such, you would independently lead and review the organizational unit???s activities to ensure the quality of work and the successful completion of the program or organization???s mission. As directed, you would work on special projects and executive correspondence. When required, you would act as an advocate or witness on behalf of the Department in conferences, hearings, or civil actions. In connection with these assignments, off-shift work may be required.

NOTE: Most Tax Compliance Agent positions will require candidates to possess a valid NYS driver???s license at the time of appointment and continually thereafter; other positions will require candidates to demonstrate their continued capacity to meet the transportation needs involved in carrying out their work responsibilities.

Multiple Examinations Scheduled for the Same Day

Eligibility for Examination

To be eligible to compete in this examination, you must be employed in the specified department or agency on a permanent or contingent permanent basis in the competitive class, or in the non-competitive class or labor class if specifically noted on this announcement (or be on an appropriate preferred list), and have the specified time in the specified title or salary grade. You may not compete in a test for a title if you are permanently employed in that title (unless you are still on probation) or in a higher direct line of promotion.

Cell Phones or Electronic/Communication Devices at the Test Site

Do not bring cell phones, beepers, headphones, or any electronic or other communication devices to the test site. The use of such devices at the test site in the test room, hallways, restrooms, building, grounds, or other areas could result in your disqualification.
